Waiver, Release of Liability and Assumption of Risk Agreement
By signing this Agreement, I agree to take responsibility for my own actions while participating in the Weekend Angler Tournament Trail (WATT) activities. That activity that I am engaging in is not without risk. This list by no means describes all of the risk, but some of these risks can include: snow; ice; rain; hail; sleet; lighting; falling objects; wind; extreme hot and cold temperatures; capsizing; drowning.
I understand that engaging in this activity may require a degree of skill and knowledge different than other activities and that I am responsible as a participant. I acknowledge that Weekend Angler Tournament Trail (WATT) has been available to more fully explain to me the nature and physical demands of this activity and the risks, hazards, and damages associated with this activity. I certify that I am fully capable of participating in this activity, therefore I assume and accept full responsibility for myself and all minor children in my care, custody and control of bodily injury, death, or loss of personal property and expenses as a result of those inherent risks and damages identified herein and those inherent risks and damages not specifically identified, and as a result of anyone’s negligence in participating in this activity.
Therefore, in consideration and as part payment for the right to participate in the activities offered by Weekend Angler Tournament Trail (WATT). I agree to RELEASE, HOLD HARMLESS and IDEMNIFY Weekend Angler Tournament Trail (WATT) its owners, employees, and agents from any and all liability, claims and causes of action arising out of or in any way connected with my participation, or the participation of any minor that I am signing on behalf of, in any activities offered by Weekend Angler Tournament Trail (WATT). I personally assume all risks in connection with these activities. If I am signing on behalf of a minor, I further agree to HOLD HARMLESS and IDEMNIFY Weekend Angler Tournament Trail (WATT) and its owners, employees and agents from all liability, claims and causes of action which the minor may have arising from the minor’s participation in activities. The terms of this agreement shall serve as a release and indemnify agreement for my heirs, personal representatives, and for all owners, employers, and agents of Weekend Angler Tournament Trail (WATT). (Parents or Legal Guardians must sign for all persons age 18 or under.)
Any claim or controversy arising out of or relating to this agreement or the performance thereunder, including without limitation any claim relating to illness or death, or damage to or loss of personal property, shall be settled by binding arbitration with a three arbitrator panel according to the rules of Alabama Arbitration and Mediation Service and the laws of Alabama State. This agreement to arbitrate does not waive or modify the liability release contained in the above paragraphs. In the event that any part of this Waiver, Release of Liability and Assumption of Risk Agreement is declared invalid or unenforceable, that part shall not affect the remaining parts and they shall remain in effect.
This tournament is a two man team tournament with the cost for each tournament at $60.00 per tournament. There is a one time charge per team of $50.00 for a membership per year. We use the membership money for operating expenses, all other money is a 100% pay back. The 2 day Classic fee will be $100 per boat.
I have read this Release of Liability and Waiver Agreement, fully understand its terms and sign it freely and voluntarily.
